Contract of employment

Now I will explain why it is important to provide staff with a contract of employment. A contract is an agreement between two or more parties, no matter the type of work one has applied for whether it’s temporary, seasonal or permanent it is stated by law that employees must be given a copy of contract within two months of starting at the work place. It’s therefore important to provide employees a contract of employment for the following reasons:

It enables the employee to know their rights and privileges at M&S. What the employee can do and cannot do, what order opportunities are available to him and what he is entitled to. It describes the legal relationship between the employee and his employer (M&S). E.g. it tells who the employee is meant to report to after performing his/her duty, like in a flat structure the employee can just report directly to the employer while in a hierarchical structure he will have to report to the team leader who passes the information to the supervisors etc.

employee if he/she goes against the contract. Disciplinary action can be taken in form of fine or not paying the employee some entitlements in some cases. The employee can also sue M&S if he/she feels he/she might have been taken advantage of or if M&S has breached the contract.

Signing the contract implies the employee has agreed to the terms and condition of M&S, therefore the employee and his/her employer (M&S) are bind to it. This can serve as evident in the court of law if one party goes against what is stated in the contract and one is suing the other for not abiding by what is stated in the contract. It sometimes answer further question that the employee might need an answer to. E.g. How many hours they will be working everyday or every week which in the UK is stated by law that no employee is allowed to work more than 8hours a day, how many days they are allowed to go on holiday within maybe a year or a month, the amount of money they are going to be paid while working in the organization which must not be less than the minimum wage, what other opportunities are available to them in M&S etc
